Timeline: Terms of Service

These Terms are the agreement between you and Disket France ("Disket", "we") when you use Timeline. We tried to make them readable. If a clause is unclear, write to us at hello@disket.app and we will explain it.

The four things to know

  • You must be 17 or older to use Timeline.
  • What you share stays between the two of you. Photos and comments on a moment are visible only to the friend who was there with you, never on a public feed.
  • Friendships fade. If you don't see a friend in real life for about a year, their freshness mark on your timeline silently fades. The friendship is not deleted; the colors simply tell the truth.
  • You can delete your account at any time from inside the app, and your data goes with it.

1. Acceptance

Using Timeline means you accept these Terms and the Privacy Policy.

By creating a Timeline account, installing the app or using the service in any way (together, the "Service"), you agree to these Terms of Service ("Terms") and to the Privacy Policy. If you do not agree, do not use Timeline.

2. Who we are

Disket France, a French SAS based in Paris. That's the entity behind Timeline.

Timeline is operated by Disket France, a French simplified joint-stock company (société par actions simplifiée) with share capital of €1,000, registered with the Paris Trade and Companies Register (RCS Paris) under number 944 134 329, with registered office at 67 rue d'Aboukir, 75002 Paris, France. Intra-community VAT number: FR89 944 134 329. Disket France is the controller of your personal data under the EU and UK General Data Protection Regulation.

3. Eligibility

17+, legally allowed to enter contracts, not banned by us before.

You must be at least 17 years old to use Timeline. You also represent that (a) you have the legal capacity to enter into these Terms, (b) you are not legally prohibited from using the Service in your country of residence, and (c) Disket has not previously terminated your account for a Terms violation.

4. Your account

One account per person. Use a real name and a real photo. Keep your sign-in safe.

To use Timeline you create an account with your phone number or Apple ID and a short profile: first name, username, optional bio, optional profile picture. Some rules:

You can delete your account at any time from Settings → More → Delete account. Deletion is irreversible. See the Privacy Policy for what happens to your data.

5. How Timeline works (and what you are agreeing to)

Timeline runs Bluetooth in the background to detect when friends are nearby. That is the product.

You acknowledge and agree that Timeline's core function depends on the following mechanics, which you are activating by using the Service:

6. Your content

You own what you create on Timeline. We only host it so we can show it back to you and your friends.

You retain all rights in the comments, photos, profile information and other content you submit to Timeline ("Your Content"). You grant Disket a worldwide, royalty-free, non-exclusive licence to host, store, transmit and display Your Content only to the extent strictly necessary to operate the Service for you and the friend with whom a moment is shared. This licence ends when you or we delete the content. We do not use Your Content for advertising and we do not use it to train artificial-intelligence models.

You are responsible for Your Content. You represent that you have the right to share it and that it does not violate any law, contract or third-party right.

7. Comments and shared photos

Comments and photos you add to a moment are shared with the friend who was there. You can edit or delete your own at any time.

Either friend in a moment can add comments and attach photos to it, and both of you can see them. You can edit or delete the comments and photos you posted at any time; you cannot edit or delete the other person's. Photos that Timeline matches from your own library by time are shown only on your device and are never uploaded unless you choose to attach them. Full account deletion removes your comments and attached photos along with the rest of your account.

8. Friendships fade

If you don't see a friend in real life for about a year, their colour on your timeline silently fades. We do not delete the friendship — we just stop pretending it's fresh.

Each in-person moment refreshes a friendship's "freshness" mark for approximately nine to twelve months. If no in-person moment occurs in that window, the friend's avatar on your home row gradually desaturates and a "decay" pill replaces the active-streak pill. This is decoration — the friendship and your moment history remain intact. You acknowledge that this behaviour is part of the Service and may be tuned over time.

9. What other people can see

Your profile, and what you put on the moments you shared with someone. Nothing more, and only the friend who was there.

The only information about you that is visible to other Timeline users is:

Your full timeline, your monthly goal, your heatmap, your snooze-when-together preferences and your moments with other friends are not visible to anyone but you. There is no public feed and no friends-of-friends visibility.

Don't use Timeline to hurt other people. Don't try to break it.

You can leave any time. We can remove accounts that break the rules.

You may stop using Timeline and delete your account at any time. We may suspend or terminate your account, with or without prior notice, if we reasonably believe you have violated these Terms, applicable law, or that your continued use creates a risk to other users or to Disket. If we terminate your account, we will explain why where we lawfully can.

Sections 6, 12, 13, 14, 16, 17 and 18 survive termination.

12. Disclaimers

We do our best. Bluetooth is imperfect. The Service is provided "as is".

To the maximum extent permitted by law, the Service is provided on an "as is" and "as available" basis and Disket disclaims all warranties, express or implied. In particular:

13. Limitation of liability

If something goes wrong, our liability is capped — except for things the law says cannot be capped.

To the maximum extent permitted by law, neither Disket nor its directors, employees or agents will be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, data, goodwill, or other intangible loss, arising out of or related to your use of the Service. Our aggregate liability for all claims relating to the Service shall not exceed the greater of (a) the amount you have paid Disket in the twelve months before the claim, or (b) fifty euros (€50).

Nothing in these Terms excludes or limits any liability that cannot be excluded under applicable law, including liability for gross negligence, wilful misconduct, or for death or personal injury caused by our negligence. If you are a consumer in the European Economic Area or the United Kingdom, you keep the full benefit of mandatory consumer-protection law in your country of residence.

14. Indemnity

If you cause us legal trouble through what you post or do, you cover the bill.

You agree to defend, indemnify and hold harmless Disket from and against any claims, damages, losses and reasonable expenses (including attorneys' fees) arising out of (a) Your Content, (b) your violation of these Terms or applicable law, or (c) your violation of any third-party right.

15. In-app purchases

If we ever sell anything inside the app, it goes through Apple.

Timeline does not currently offer in-app purchases. If we add optional purchases or subscriptions in the future, they will be processed through Apple's App Store and governed by Apple's terms in addition to these Terms. Subscriptions renew automatically until you cancel from your Apple ID account settings.

16. Apple App Store terms

Standard Apple boilerplate. The app is from us, not Apple.

You acknowledge that these Terms are between you and Disket, not Apple, and that Apple is not responsible for the Timeline app or its content. Apple has no obligation to provide maintenance and support, to address warranty claims, or to handle any claim by you or a third party relating to the app. Apple Inc. and its subsidiaries are third-party beneficiaries of these Terms and may enforce them directly against you.

17. Governing law and disputes

French law. Disputes go to the courts of Paris. EU/UK consumers keep their local protections.

These Terms are governed by French law, without regard to conflict-of-law principles. Any dispute arising out of or in connection with these Terms or with the Service shall be subject to the exclusive jurisdiction of the courts of Paris, France, except where mandatory law in your country of residence provides otherwise. As a consumer in the European Economic Area or the United Kingdom, you keep the right to bring proceedings in the courts of the country where you live.

Before filing a claim, please contact us at hello@disket.app; many issues can be resolved quickly that way.

18. Changes to these Terms

If we change anything material, we tell you inside the app before it takes effect.

We may update these Terms from time to time. When we make a material change, we will notify you inside the app or by another reasonable means at least fourteen days before the change takes effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms. If you do not agree, you can delete your account before the change takes effect.
